Board disciplinary panel approves settlement orders, remedial plans, penalties and dismissals

The Disciplinary Review Committee of the Texas State Board of Dental Examiners on Feb. 20 voted to approve multiple enforcement-related items including agreed settlement orders, remedial plans, an agreed administrative penalty and consent orders.

Miss Sanchez, board staff, told the committee that "the agreed settlement orders are in your materials for you to review. Board staff are asking that you approve the agreed settlement orders as presented." A motion to approve the package was made and seconded; Doctor David Yu requested that case number 202001097 be pulled and considered in executive session before the board acted on that specific matter. The committee moved into executive session for that case; the rest of the settlement orders were then approved by voice vote and recorded as passing unanimously.

After returning from executive session Miss Sanchez presented the remedial plans and asked the committee to approve those "as presented by staff." Motions to approve the remedial plans, the single agreed administrative penalty on the agenda and the consent orders each passed by voice vote with no recorded dissents.

The committee then considered pre- and post-Independent Screening Committee (ISC) recommendations of dismissal. Miss Sanchez explained the recommendations were listed in the committee materials and asked for motions to approve them. Following brief questions from committee members, motions to approve both the pre-ISC and post-ISC recommendations of dismissal were passed by the committee.

The committee chair and staff emphasized that, consistent with the board's usual practice, open cases and items that require further legal discussion were handled in executive session. The recorded motions in the public record were limited to whether to approve the packages presented by staff. The transcript reflects unanimous committee approval for the items presented at the meeting.
