The Texas Department of Motor Vehicles Board voted unanimously July 10 to revoke the general distinguishing number (GDN) of Fan Quality Motors, assess a $15,000 civil penalty and order a $6,342.50 refund to a purchaser following an administrative record compiled at the State Office of Administrative Hearings (SOAH).
The Board accepted the Administrative Law Judge’s Proposal for Decision (PFD), which found that the respondent failed to transfer title for two vehicles, issued two buyer’s temporary tags for the same vehicle, did not have employees present during two premises inspections, and sold or offered vehicles from locations other than its license location. The ALJ additionally found evidence that Fan Quality Motors “willfully defrauded” a buyer and allowed others to misuse its GDN to buy and sell vehicles, and recommended revocation and the stated penalties.
General Counsel Laura Moriarty summarized the SOAH findings and instructed the Board that its role was to determine whether the ALJ correctly applied statutes and rules and whether the recommended sanction was appropriate; the Board may not receive new evidence. The department’s attorney, Robert Rice, told the Board the documentary and testimonial record supports the ALJ’s factual findings, including documentation that Fan Quality previously owned and sold the vehicles at issue. Respondent’s counsel Aman Obas argued the record was misread in places, asserted his client operated a title‑only business in some transactions, and disputed assertions that purchasers were defrauded.
After brief Board discussion, Vice Chair Tammy McRae moved to accept the PFD and adopt findings of fact and conclusions of law as written, and to implement the ALJ’s recommended sanctions. Member Schlosser seconded the motion. The Board then voted by roll call; members Alvarado, Gilman, Graham, Jones, McRae, Schlosser and Chair Bakkeris voted aye. The motion carried unanimously.
The Board’s action is administrative and follows the SOAH fact‑finding; the Board did not take new testimony. The order adopted the ALJ’s sanctions: revocation of Fan Quality Motors’ GDN, a $15,000 civil penalty, and a full refund of $6,342.50 to the purchaser identified in the SOAH record.
The Board’s decision and the underlying administrative record (SOAH PFD) provide the basis for any future compliance steps or court review by the affected party.
