Board members and landowners debated a significant appraisal discrepancy for one of the farms in the pipeline, and whether the board could rescind acceptance of an earlier appraisal so the appraiser could revise its figures.
An applicant said the appraisal the board previously accepted differed materially from another appraisal they had and asked the board to rescind its prior acceptance so the original appraiser could revisit his methodology. David (staff member) said the board had already accepted the original appraisal at a prior meeting and that state rules and the board’s bylaws constrain options. Board members cited Robert’s Rules of Order and voiced uncertainty about whether rescinding a motion after the meeting’s closure was possible without solicitor guidance.
Given the legal questions, the board made a motion and voted to have David contact the solicitor (Jenny Cheng) for direction and to communicate with involved owners and appraisers. The board also discussed that individual owners may obtain a second appraisal at their own expense; staff noted the claimant has the option to submit a second appraisal back to the board by Feb. 28 to preserve program options.
The board tabled any formal rescind action pending legal counsel and instructed staff to report back with the solicitor’s advice.
