The Cobb County Planning Commission on Nov. 4 denied a temporary land‑use permit request that would have allowed outdoor storage of construction materials and a shipping container on property used by an apartment owner, citing repeated violations and prior zoning stipulations.
Owner William Shelman told the commission the materials and container were for an addition to his home and that the items would be removed when construction finishes. "All that's down there are the building materials, the cinder blocks, the siding, the lumber... All that's left is for the construction of my home," Shelman said.
Yolisa Foster of county Code Enforcement summarized a series of enforcement actions: complaints beginning Jan. 2025, notices issued for customary home occupation, parking standards and outside storage, and a June court appearance in which the owner pleaded guilty and paid fines. Foster said the property remains out of compliance and noted prior 2024 zoning stipulations requiring removal of equipment, trucks and trailers within six months.
Planning staff recommended denial, noting that shipping containers and prolonged outdoor storage in residential areas have negative neighborhood effects. After discussion, commissioners voted to deny the LEP but set a six‑month deadline for full compliance and required a three‑month check‑in by code enforcement to document progress. If progress is not shown at the interim check the commission noted enforcement may accelerate.
