Valley County approved a written decision modifying the McCall area of impact boundary during a special session on May 5.
The county’s prosecuting attorney, identified in the meeting as Prosecuting Attorney, told commissioners, "This is the written decision that's required on your area of impact boundary," and said if the board approved the document without modification, "we'll get it recorded today." A member who reviewed the draft praised the document as factual and consistent with state law, saying, "You did a fabulous job in my opinion. You have, encapsulated all of our comments very well. And, I think you did a great job with comparing what what, the thought process was behind this whole thing and making sure that we're following state law."
The chair moved to approve the document, stating, "I'll make a motion to approve the document of the McCall area of impact boundary as approved. Second." The motion was seconded on the floor (the transcript does not identify who seconded). A voice vote followed; a board member announced, "All in favor? Aye," and the chair concluded that business on the issue was complete.
After the vote, officials were asked to sign the approved documents. The prosecuting attorney noted there is "a color map attached to 1 of those copies" and asked that it be given to "Kurt Miller" so the decision can be recorded.
At the end of the session staff also noted upcoming calendar items: Dec. 1 for comprehensive plan amendments and code changes and Dec. 8 for code changes to Title 7. Participants clarified that the first date was Dec. 1.
The record indicates the board approved the written decision and directed staff to record it; the statutory citation requiring a written decision was referenced generically in the meeting as "the statute" but was not named in the transcript.
