Council to consider variances and a paper-street vacation that could free developable lots

The Committee of the Whole on Nov. 5 heard two land-use items that are scheduled for additional review by council.

Mr. Ovi described an application concerning 33 East Third Street in the Traditional Town Neighborhood. "The applicant is proposing to turn the Second Floor of the garage into a third dwelling unit on the property," he said, noting the zoning officer had determined the use was not permitted given ordinance rules about first-floor residential use and the prohibition on two principal uses on a single lot. A hearing is advertised for Nov. 18 at 7 p.m., and council will list the item for potential action on the next Monday agenda.

Separately, borough staff reported on a petition to vacate a paper street that runs between two parcels near 618 Lincoln Avenue. The property owner petitioned council to vacate the right-of-way so both adjacent parcels can be sold to a developer. Staff said the petitioner agreed to pay all costs associated with the vacation, waived claims for liability arising from the action and would indemnify the borough. The manager and staff explained the historical context of "paper streets" as mapped but never opened roads and described the required process: authorization to prepare and advertise an ordinance, a public hearing, then potential adoption.

Both items were placed on the Monday agenda for authorization to advertise; the zoning hearing will occur Nov. 18. No final council actions were taken Nov. 5.
