Board approves reduced‑parking variance for Timaeus Barbecue with conditions including timetable for enclosed cooking area

The Board of Commissioners approved a request to reduce minimum off‑street parking for Timaeus Barbecue and to permit a limited outdoor seating area.

Planning staff advised that the request would reduce required parking from 73 spaces to 34 and add an outdoor seating area that would otherwise require five additional spaces. Staff recommended denial because the expansion increases a nonconforming site condition, but presented proposed conditions if the board chose to grant the variance. Those conditions limited the outdoor seating area, prohibited amplified sound and outside cooking not compliant with UDC standards, prohibited use of existing parking spaces for seating or loading, and required the applicant to submit plans and complete construction of an enclosed cooking area within six months; a temporary certificate of occupancy could remain in effect until construction was complete.

The applicant, Ramon Nunez (owner), told the board the action was necessary to obtain an alcohol license and to help business viability. He said the building’s recorded square footage includes an unfinished basement not used by customers and that the health department had approved the current smoker setup; he indicated willingness to build a compliant enclosed cooking area per staff conditions within the timeline.

Commissioners approved variance P25‑0133 with the seven staff conditions. The approval allows limited outdoor seating and a temporary operating arrangement while the applicant moves toward a permanently compliant enclosed cooking area.
