Attorney says 13 Ion Circle split will leave both lots conforming; board asks applicant to show utility easement

Attorney John Kelty presented an Approval‑Not‑Required plan for 13 Ion Circle (Map 75, Parcels 174 & 174A) in the R2 zoning district and said the proposal shifts the lot line so each parcel retains sufficient area and frontage under zoning.
Kelty told the board the property is owned and managed by affiliated entities of a single client and said the change is intended to enlarge what would be shown as lot 4A. “Both lots will have sufficient area and footage in their zoning district such that they will not become any more non‑conforming,” Kelty said.
Board members and staff raised a separate, material issue: an underground electric utility easement and a junction box appear to cross the parcel and, in the applicant’s iteration, would end up entirely on lot 4A. Board members said the easement must remain on the public record and must be redrawn so it is correctly located on the final plan; PMLP coordination and potential permanent easement documentation will be necessary. Kelty acknowledged the easement and said the registry of deeds record will retain the easement once shown.
The applicant asked for an opportunity to correct and resubmit the plan to reflect the easement and other clarifications; the board voted to grant the petitioner’s request to extend time to edit the plan so the applicant can supply a revised set of drawings showing the easement and other changes.
The board’s motion to grant the extension was made and seconded and recorded as unanimous.
