Planning Commission approves Pivotal Acres 3‑lot minor subdivision in New Durham Township

The LaPorte County Planning Commission on Oct. 28 approved a three‑lot minor subdivision petition submitted by Brent Chubb to be known as Pivotal Acres.
The petition covers a 53.61‑acre parent parcel in the northeast quarter of Section 25, Township 36 North, Range 4 West in New Durham Township (parcel ID 46092520004000027), located just south of 4295 South 650 West. Commission staff read the legal location into the record before the applicant’s presentation.
“My name is Matt Gaertano … Charles Hendricks and Associates Engineering and Land Surveying,” the applicant’s engineer said, describing the proposal as a straightforward minor subdivision in which each of the three lots exceeds current frontage and one‑acre minimums and will be served by private septic systems and wells. He said soil borings are located west of the vegetation line and LaPorte County Health Department design specification sheets have been received.
Commission members pressed the applicant on an area shown as wetland in the National Wetlands Inventory (NWI). Gaertano said the project team has a letter from a soil scientist disputing the NWI mapping and that the borings and septic areas are outside the vegetated line. “I can provide you a copy of that letter if you’d like,” he said.
A building‑department staff member told the commission the petition had been subject to the county’s technical review committee and that members who were absent had submitted comments into the review software; the staff member said the committee had no unresolved issues at the time of the meeting. Staff also said the Army Corps of Engineers and other jurisdictional checks would be completed before any building permits are issued.
There were no remonstrators present. A motion to approve the Pivotal Acres minor subdivision was made, seconded and carried by voice vote.
The commission’s action approves the minor subdivision; building permits will still require site plans, verification of soil borings, LaPorte County Health Department septic approval and any necessary federal or state signoffs before construction begins.
