The Mount Pleasant City Council on Oct. 21 approved a contract adjustment to the Southside Wastewater Treatment Plant project that staff described as an equitable payment for extraordinary bypass-pumping and screw-pump repair work.
Staff reported that Change Order No. 2 totals $352,000 and represents a negotiated equitable adjustment that had been discussed in prior executive session; the amount is being treated as a 50/50 split for extraordinary costs. The council also approved Pay Request No. 28 to Heritage Construction LLC in the amount of $217,112.04 for electrical improvements and bypass-pumping costs included in the work.
City Attorney Lee told the council the amendment and payment are intended to address the expenses while preserving both parties' rights to pursue claims later if new facts emerge. The adjusted contract total after the change order was presented on the record and the council voted unanimously to approve the change order and pay request.
Staff listed the adjusted contract amount after the change order and the project's cumulative billed-to-date figure on the record; staff also said the change order language was intended to be without prejudice to either party's legal rights.
