The Oskaloosa City Council adopted on second reading an ordinance adding Chapter 10.77 to Title 10 of the Oskaloosa Municipal Code to permit alternative enforcement action. The new chapter authorizes the Oskaloosa Police Department to issue civil notices of violation for specified minor offenses instead of issuing a state citation or pursuing a municipal infraction through the courts.
Staff said the change is intended to streamline enforcement, reduce court caseloads and provide a quicker city-administered penalty option for minor traffic, animal control and nuisance violations. The ordinance follows similar measures used in nearby communities identified by staff.
During discussion, the police chief (name not specified in the transcript) said officers would still provide accused persons opportunities to contest charges: "If they choose not to [pay] or if they want to dispute, we would just reissue that state citation so they could still have a chance to go to court." The chief also said the new process could reduce paperwork currently required to refer a municipal infraction to the city attorney by allowing officers to document and issue a notice more directly.
Councilmembers asked about systems integration and tracking repeat violations; staff said they are working with the judge, the auditor and state offices to establish the computer workflow and, in the interim, could use secure forms to record violations.
