Middletown staff seek wording fix before transferring Amy's Kitchen water agreement to Goshen

Staff told the board Oct. 31 they are negotiating an agreement to transfer Amy's Kitchen water and sewer responsibilities to the town of Goshen, which would create its own water and sewer district to assume service. Mr. Tewil said the team found a conflicting clause in the draft agreement: one paragraph states the agreement life is 40 years, while another section commits the city to provide water and sewer "as long as the water and sewer district exists," without a 40-year limit.

"Here is the only comment I found, so I I'll look so you know, is is 1 paragraph, it says that the life of this agreement is 40 years. In another section of the agreement, it says the life of the agreement is not the life of the agreement, that the city is committed to provide water and sewer as long as the, water and sewer district exists. There's no 40 year 40 year limitation. So there's a contradiction to this conflict," Mr. Tewil said. He said staff exchanged messages with the town and provided his cell number to clarify language and that a board meeting or a written document can be prepared for Monday so the council can vote on a resolution.

The mayor said staff will speak to the council Monday when ready. No formal action was taken at the Oct. 31 Board of Estimate and Apportionment meeting; staff said they may request a council resolution next week after the draft wording is reconciled.
