Conservation commission approves ORAD for Bear Hole/Highstone pending peer-review letter

The Taunton Conservation Commission voted Oct. 6 to approve an Order of Resource Area Delineation (ORAD) for 0 Bear Hole and 0 Highstone Street, with the decision held until the commission receives a written confirmation from its peer reviewer.

The vote followed a detailed peer review by Sam Crow of Ecosystem Solutions, who said his team reviewed the ANRAD form, the submitted site plan and a wetland resource assessment, and conducted site visits with the project wetland scientist. "We found a missed wetland, Northeast of the WFW 9 series," Crow said, and flagged several locations where he observed sphagnum moss and other wetland indicators. He also reported mapping additional potential vernal pools beyond those previously identified by NHESP and recommended those be called out on the plan.

Niles Vega of Zenith Consulting Engineers confirmed the applicant added flags to the plan and submitted revised drawings the same day; staff member Jenna Freitas told the commission the latest plan had been uploaded that day after a survey crew located the new flags. The peer reviewer and the wetland scientist then walked the flagged areas together; Crow said the review found an off-site upland ridge that separates two small wetlands from off-site wetlands, supporting the consultant's view that those features are isolated wetlands rather than bordering vegetated wetlands.

Commission discussion centered on whether to continue the hearing so members and the public could review the late-submitted revisions or to approve with conditions. "I don't have an issue with approving this tonight subject to a letter from our consultant saying that she's that everything has been addressed," said one commissioner during deliberations. Commissioner Debbie opposed immediate approval, citing a standard that applicants provide materials to the commission before the meeting: "We hold everybody else to the feet the to the fire to state that everything has to be in here before this meeting. So, it wasn't here before this meeting and it's the same day. So I am gonna be voting against this because I'm gonna stand strong to the standards," she said.

Commissioner Josh moved to issue the ORAD with the caveat that the commission withhold distributing the final decision until it receives a confirming letter from the peer reviewer, and the motion passed with one vote against. The chair clarified the commission will not send out the decision until the peer review letter confirming the small flagged wetland and any vernal-pool findings is filed with the commission.
