The City of Cody Planning and Zoning Adjustment Board voted Nov. 6 to revoke Conditional Use Permit (CUP) 2025-01 for a large-scale home occupation at 235 Cooper Lane West, citing repeated noncompliance with permit conditions.
Planning staff told the board the CUP was approved May 1, 2025, and included a condition requiring that all firewood materials be stored inside an existing building by July 30, 2025. Staff said photographs taken between Aug. 12 and Oct. 20 show log stacks outdoors and the delivery of a semi-truck load of logs, which staff said indicates the business remained in violation of its CUP and city code. Staff recommended revocation and proposed a compliance deadline of Nov. 15; the applicant requested an extension to Jan. 1.
A neighbor who identified themselves as living behind the property raised concerns about frequent deliveries, noise and safety. Planning staff said the city had sent certified notices and that the last formal notice went out Sept. 29. Staff also noted the applicant dropped off a letter requesting a Jan. 1 compliance extension.
Board members debated the request for more time. Multiple members said the permit holder had received previous notices and that additional large deliveries while out of compliance weighed against granting an extension. Ian moved to revoke the CUP with the requirement that the permit holders remove all materials associated with the large home-occupation business and cease business operations by Nov. 21, 2025; Joe seconded. The chair called the voice vote and declared, “Ayes have it.”
The board’s action revokes the special authorization for the business activity beyond what is allowed for ordinary residential firewood use; planning staff said that revocation would not prevent homeowners from storing firewood for household use under standard residential rules. The record before the board did not specify any additional fines or a formal enforcement timeline beyond the removal and cessation date set by the motion.
The planning office will follow up on the board’s direction and pursue enforcement under city code if the permit holder does not meet the Nov. 21 deadline.
