Planning commission holds work session on bylaws, ex parte rules and open-meetings obligations

At a work session following the regular meeting, staff led commissioners through a review of the planning commission's bylaws, authority and ethics obligations, emphasizing disclosure of off-record contacts and avoiding serial deliberations outside public meetings.

Ray (staff) framed the discussion by explaining the sources of the commission's authority: state statute, the county general plan and the county development code, and he urged commissioners to treat the bylaws as guiding principles. Staff member Helen reviewed expected conduct: "if you stand to either gain financially or if you feel like you have a bias 1 way or another ... the recommendation is that you remove yourself from any kind of a decision making role" to avoid the appearance of impropriety.

Members discussed ex parte contacts and what to disclose. Ray described an acceptable disclosure example for a commissioner who had a conversation with a member of the public: "The chair introduces the item ... before we get started, I'd just like to disclose. I had a discussion with the person about this, and I encouraged them to come to the meeting," and said that simple disclosure on the record is usually sufficient. Helen advised commissioners to contact staff if they are unsure whether a conversation requires disclosure: "If ever you have a question or, you know, jeez, I had this conversation, and I'm second getting guessing myself, you know, feel free to call me, email me, and I can kind of give you some guidance."

Staff warned against private deliberations or secret text chains among a quorum of commissioners. "Those deliberations should happen in public because it's not fair to either side," one presenter said, and Helen cautioned that serial communications and off-record deliberations can risk violating the Open and Public Meetings Act and that communications may be subject to public-records requests.

Staff also reviewed meeting types (regular meetings, special meetings, work sessions and site visits), noting that work sessions and site visits are discussion-only and not venues for votes. Commissioners discussed limits tied to recent state rules that can restrict subdivision applicants to a single public hearing in some circumstances, and staff described the mechanics for amending the bylaws (discussion at a public meeting followed by a majority vote and ratification by the county manager).

The commission discussed membership rules in the development code that limit municipal residents on the commission and reviewed upcoming term renewals, recruitment, and a planning-lab training session beginning in February. No formal decisions or votes were recorded in the work session; staff encouraged commissioners to propose specific bylaw changes for future meetings.
