Somerville updates zoning tables to permit state-recognized home-based child daycare in residential districts

Planning staff told the Land Use Committee that Massachusetts amended M.G.L. c.40A s.3 to require that municipalities permit family child care homes and large family child care homes. The city proposes revising the Somerville zoning use tables (Article 9 and several district tables) to list "home-based child daycare accessory use" as a permitted accessory use in every district where residential housing is permitted.
The presentation said the change aligns Somerville's zoning with state law and that staff used the occasion to correct discrepancies in the main use table caused by prior amendments to individual districts. The committee opened and then closed a public hearing with no speakers; the public comment period remains open until Nov. 21.
