Commission affirms administrative dismissals, denies reconsideration requests and moves into closed session

Commission staff recommended, and the commission adopted, administrative dismissals and denied requests for reconsideration in multiple complaints.

For one complaint the complaint-review committee recommended dismissal because staff found no violation on the underlying facts and because the commission concluded that a process server has no duty under Texas Rule of Civil Procedure 107 to include a physical description in the return of service; the commission acted on the committee recommendation and dismissed the matter. The commission also affirmed an administrative dismissal (Roman numeral 10 combined with reconsideration item 0737) where the staff found the complaint did not sufficiently allege misconduct (no corroborating video, no admissions, no convictions or deferred adjudication) and denied the complainant's request for reconsideration.

In a separate reconsideration request (Cause No. 0604) staff reported that the respondent had paid for the transcript before the reporter's motion was heard and that the allegations cited were not sanctionable under the code of ethics for court reporters; the commission voted to deny reconsideration and maintain the administrative dismissal. After resolving public items the commission announced it would recess into closed session under the public meetings policy to deliberate on applicant privacy and personnel matters and stopped the live YouTube stream.
