Commissioners asked staff to clarify how the form would apply to renewals and standing contracts. A commissioner noted the form appears useful for brand-new contracts and asked whether renewals would still come before the board. Michael (staff member) said renewals would still be presented to the board but the form could reduce repetitive information for recurring contracts. Another concern raised was a paragraph in the proposed form that commenters said read like employment-language or a waiver; a commissioner said that clause needed review and may require routing through administrative rulemaking.
Board members framed the checklist as a checks-and-balances step intended to capture who reviewed a contract and when, reducing the risk that warranty language or other contract clauses "slip through the cracks." One commissioner said the process is more work but worthwhile if it reduces liability: "Yes, it's tedious. Yes, it's more work. But in the run is it worth it? If something goes wrong it probably is."
The motion to place the item on the next agenda was seconded and approved by voice vote. Commissioners directed staff to return the revised form with suggested edits so the board could consider a cleaner, shorter version at that meeting.
The board did not adopt the form at this meeting; the item will return for formal consideration and any subsequent action.
