Board postpones cultural center hearing and another case to Dec. 4 for procedural requirements

Case 2025‑112 (1205 Linden Avenue) was called and the applicant requested a deferral; the board agreed to reschedule the hearing for Dec. 4 so the applicant can complete required steps. No vote was required to defer.
Case 2025‑114 (631 Old Lebanon Pike), filed by appellant Dean Patel for the Gujarat Cultural Association, was not heard because the board’s rules require a neighborhood meeting for special‑exception requests and the applicants had not held one during this application cycle. Staff reminded the board that the site previously received a special‑exception approval on Dec. 7, 2023 that was conditioned on NDOT approving a supplemental traffic study; that approval required a building permit to be issued by Dec. 8 of the approval year or it would expire. The applicants acknowledged they cannot obtain their building permit before Dec. 8, so they sought the board’s review; the board paused the hearing and instructed them to resend notices and hold the required community meeting before the Dec. 4 hearing.
A staff member reminded the room that previous failures to hold neighborhood meetings had led to a court reversal of a board approval, which is why the board enforces the meeting requirement. The cultural‑center applicant was told to reissue notice to neighbors, hold the neighborhood meeting and return on Dec. 4 at 1:00 p.m. in the same room.
