The Nampa City Council adopted a resolution intended to "self-cure" alleged procedural violations of the Idaho Open Meetings Act tied to executive-session discussions regarding the Fort Idaho Center.
City attorney Preston Rudder presented a letter read into the record from Twin Falls County Prosecuting Attorney Grant P. Loebs, who said he reviewed the complaint referred by Canyon County and concluded the core issue concerned whether the city had properly entered executive session under Idaho Code provision cited in the letter. Loebs wrote that while exceptions to open meetings must be narrowly construed, his review suggested the city had substantial evidence of public deliberations on the Fort Idaho Center through public hearings, workshops and meetings, and he did not find that any procedural error was causally connected to a subsequent action requiring nullification.
Preston told the council the language before them had been refined with input from the county prosecutor. Some council members said they wanted more time to read the updated language; others said the prosecutor's letter and the revised resolution addressed the enforcement agency's concerns. After discussion, the council adopted the resolution by roll call (four yes, two no). The council asked staff to provide an executed copy of the resolution to the county prosecutor, who had said he would consider the matter closed upon receipt.
