City staff and a developer team discussed Kedron Square road improvements during the board's Oct. 7 work session and asked for direction on splitting a single performance bond so most improvements convert to a maintenance bond while leaving a smaller performance bond in place for one remaining turn-lane item that is delayed by an AT&T utility pole relocation.
Staff reported the city currently holds a performance bond for Kedron Square for road improvements in the amount of $242,006.87. The improvements include a left-turn lane to the Kedron Square entrance, a deep cell lane at that entrance, and a turn lane at Kedron Road and Old Kedron Road. The developer told staff the parcel of work that includes the Old Kedron turn lane cannot be completed by the Oct. 14 date stated in a prior resolution because an AT&T pole must be moved; the AT&T relocation timeline is utility-driven and takes months to engineer and schedule.
The developer requested the city convert the completed portions to a maintenance bond and retain a performance bond only for the Old Kedron turn lane, with the developer returning the remaining performance work to complete by May 11, 2026. Staff said School Street work is nearly complete and that, weather permitting and with required approvals, the Old Kedron work is achievable but depends on AT&T's construction schedule.
The board indicated it would support resolutions to set new dates and a revised bond structure if staff can confirm the completed improvements by Oct. 14. Staff said once the city can certify completion of the covered work, the bonding company will issue the maintenance bond and a new performance bond can be established for the remaining turn-lane work.
No formal bond call or unilateral action was announced at the meeting; the board directed staff to prepare resolutions to implement the proposed split and updated dates if the work is verified as complete.
