Homeowner Dragon Stanchovich asked the Planning Commission to recommend reducing a 20‑foot drainage easement along the rear of 2975 Stuart Campbell Point to 10 feet so a swimming pool and deck can be installed.
Planning staff said public‑works review found that an adjacent, dedicated drainage easement on neighboring properties provides sufficient conveyance and access so the subject easement could be narrowed to 10 feet without creating storm‑water or maintenance access problems; because the easement is already dedicated to the city, Planning Commission’s role is advisory and any final vacating or reduction must be acted on by the Board of Mayor and Aldermen (BOMA).
The homeowner explained earlier permitting confusion related to a separate fire pit built within the easement and said he would accept responsibility to relocate or remove features on short notice if city maintenance required it. Commissioners and staff noted that any agreement and the record of the easement reduction would be public record and that property sellers must disclose encroachments or special agreements during sale; staff and the city attorney said such disclosure obligations fall to the seller and are not a matter the Planning Commission needs to memorialize beyond the public record.
No members of the public offered opposition at the work session. Staff recommended forwarding the item to BOMA with the finding that the drainage easement can be reduced to 10 feet without creating stormwater or maintenance access issues. There was no vote at the work session; the matter will proceed to BOMA action.
