Oklahoma Supreme Court accepts resignation of attorney Tracy Smith Zoll amid pending criminal charges

The court said in its written order that Zoll voluntarily executed an affidavit of resignation on Sept. 15, 2025, asking to relinquish her right to practice law and to have her membership in the Oklahoma Bar Association terminated. The opinion states the Office of the General Counsel for the Oklahoma Bar Association is investigating matters tied to criminal charges filed in Oklahoma County against Zoll.
The order lists criminal charges and related local case numbers: on July 23, 2025, Zoll was arrested and charged with threatening to perform an act of violence and communicating obscene threats or harassment by telephone; on Aug. 1, 2025, she was charged in separate cases with attempted kidnapping and with assault and battery upon a police officer. The court’s opinion does not resolve those criminal matters.
The court noted that Zoll acknowledged the allegations, agreed she may have violated Rule 8.4(b) of the Oklahoma Rules of Professional Conduct and provisions of the Rules Governing Disciplinary Proceedings (RGDP), and waived her right to contest the disciplinary allegations before the court. "Respondent shall be reinstated to practice law only upon full compliance with the conditions and procedures prescribed by RGDP 11," the opinion states.
As conditions of the resignation and any later reinstatement, the court ordered Zoll to comply with RGDP rule 9.1 within 20 days of the resignation date, to return all client files, to refund any unearned fees, and to reimburse the client security fund for principal amounts and statutory interest should the fund pay claims on her behalf. The court also recorded that Zoll must not apply for reinstatement for five years from the effective date of the order.
The court entered the order in conference on Oct. 6, 2025. The opinion includes the respondent’s OBA number (20850) and a roster address for the record. The opinion also records that the Oklahoma Bar Association did not seek reimbursement of investigative costs; therefore none was ordered.
The criminal cases remain matters of record in Oklahoma County and were referenced in the court’s disciplinary filing; the court’s action here addresses only the attorney disciplinary membership and conditions for future reinstatement.
