Casper council delays decision on Stoneridge property after legal guidance on bids

City staff provided council with requested clarifications on competing bids for the Stoneridge property and one bidder was present to answer questions.

Liz, speaking for staff, said written follow-up questions had been sent to both bidders and responses were included in the council packet; staff summarized proposed land uses and bid terms for council review. A councilor asked what obligation the council had when two bids differ; the city attorney responded that (as read during the meeting) "15 1 1 12" requires council to accept the highest responsible bid, that 'responsible' is a council determination of discretion, and that council could alternatively reject both bids or find one bid not responsible.

Councilors discussed factors beyond price. One councilor noted a longtime adjacent property owner (more than 20 years) submitted a lower bid after purchasing lots expecting a park and urged consideration for that history; other councilors stressed financial responsibility to the city and noted the appraisal came in higher than either bid.

A councilor asked whether sealed bids are the only sale mechanism or whether auction/other formats could be used; the city attorney said sealed bids are the general mechanism for sale to private parties, with limited exceptions for sales to governmental entities, land swaps or sole-source economic development findings.

Given the limited time left on the evening agenda and the complexity of legal and fairness considerations, staff recommended further discussion at a work session; council agreed to move the matter to the next week's work session rather than decide that night.
