The City of Kankakee Planning Board on Sept. 16 approved a major variance that will let the owner of 441 West Hawkins Street rebuild and refinance a property currently operated as a short‑term rental.
Applicant Dustin Koy told the board the house has been fully remodeled and is being used as an Airbnb; he said he sought the variance after discovering the lot did not meet minimum area requirements during refinance efforts. “We’re requesting a major variance from the minimum lot area to be able to rebuild if something were to happen,” Koy said.
Planning staff explained the request concerns only the lot‑area (a bulk standard), not a change in zoning or an intensification requiring additional parking. Staff recommended approval provided the owner satisfy requirements from the City of Kankakee Fire Department, Kankakee County Health Department and Kankakee Code Enforcement and obtain any required rental or housing licenses.
During public comment a neighbor said on‑street parking is abundant and that notified neighbors were satisfied with the explanation that the variance would allow rebuilding after a serious loss. Commissioners asked whether dedicated parking existed; Koy said there is no driveway and current guests use street parking.
Commissioner [name on roll call] moved to approve PB2025‑9‑1 and attach the planning department findings; the motion was seconded and passed on roll call. The board’s action grants the major variance subject to the listed departmental approvals and standard code compliance.
The board’s approval is final at the planning level; any building permits, code inspections or licensing required for occupancy or future refinancing must be secured before rebuilding or change of use.
