Clay County Commission authorizes sheriff retirement fund tied to new state fee

Clay County Commissioners on the evening agenda approved resolution 2025272 to establish a county "sheriff retirement fund" (Fund 955) after the Missouri General Assembly enacted House Bill 147, which amended Mo. Rev. Stat. 57.28 to add a fee dedicated to the Missouri sheriff retirement system.
"It's a $20 total new fee, but $10 will be toward the Missouri sheriff retirement system," Clay County auditor Victor Hurlburt said while explaining the mechanics of the new fund and how the county will remit the money monthly to the Missouri Department of Revenue for deposit into the state retirement system. Hurlburt said the law went into effect Aug. 28 and the county needs a dedicated fund to segregate those receipts and any earned interest.
Hurlburt told commissioners the change also increases the amount dedicated to a civil-fees fund (Fund 278): the statute directs the first $75,000 of revenue from these fees to the sheriff's civil fees fund, an increase from the prior $50,000 threshold. He also described the existing deputy sheriff supplemental fund (Fund 956), which the new law addresses separately.
Commissioner Wagner moved to approve resolution 2025272; after discussion the commission called the roll and the motion passed 6-0. The administrator confirmed the county treasurer will remit the fee receipts to the state on a monthly schedule and staff have updated the county budget to reflect the new fund and the statutory distribution.
The resolution creates Fund 955 to hold the dedicated retirement-fee receipts and tracks the county's administrative obligation to transmit the funds to the state retirement system. The county auditor and treasurer were acknowledged for coordinating implementation steps and communications with the Missouri Department of Revenue.
The commission did not attach additional conditions to the fund; staff will bring implementation details to the administrative offices and ensure the required monthly transfers are performed.
