Jackson County committee forwards rezoning of roughly 117-acre tract to full legislature with no recommendation

Legislator Lauer, chair of the Jackson County Land Use Committee, said the committee accepted public comment at a prior hearing on Aug. 18 and moved to forward Ordinance 6,009 to the full legislature without taking a committee position.
Randy Deal, Development Division, Public Works, told the committee he had received correspondence from the applicant’s representative addressing watershed concerns and offered to add that correspondence to the record. “We did get a correspondence from the applicant's representative today dealing with some of the issues with the watershed out there,” Deal said.
During questioning, a committee member asked whether the Planning Commission had approved the zoning. Deal confirmed the Planning Commission had recommended disapproval of the zoning while approving the preliminary plat, and explained the commission is advisory: “I believe the way the ordinance reads that whether or not they get a disapproval because the plan commission is a recommendation body, the applicant still has the right to proceed on to the legislative, process”. That split action—preliminary plat approval but zoning disapproval—was a focal point of committee discussion.
After brief discussion the committee voted to forward the ordinance to the full legislature with no recommendation. A voice vote was recorded in favor and the chair announced the item will move forward to the legislature for further deliberation.
