Commission backs amendment to defer 100 East improvements for 93 E 900 North development

The Planning Commission voted to recommend a development-agreement amendment for property at 93 East 900 North that defers certain required improvements on 100 East until the road and utilities are constructed.
Applicant Jay Adams, aided by Tom Merido, told the commission the developer seeks a further deferral so they can add a building and move a property line about 20 feet north without triggering the immediate obligation to complete 100 East improvements. Adams said the first deferral resulted in installation of a sidewalk and a fire hydrant and that the developer will complete utilities and road work when the roadway construction proceeds.
Staff and commissioners discussed the enforcement challenges that come with deferral agreements, the possibility of using bonds or other triggers, and noted the city did secure sidewalk and hydrant improvements under the earlier agreement. Commissioners asked for clear exhibit maps and triggers to be included in final documents; staff suggested some non-substantive drafting tweaks and clarified which exhibits should show property boundaries and building placement.
After public questioning about which streets and curbs exist and whether final engineering sign-off was complete, a commissioner moved and the commission voted by voice to give a positive recommendation to the amendment. Staff will bring the final amended agreement to council with the recommended changes and required exhibits for final action.
