The Town of Uxbridge Zoning Board of Appeals voted to grant a frontage variance for 503 Elmwood Avenue (FY2608), allowing the applicant to reduce the required frontage from 300 feet to 46.75 feet for a single‑family dwelling.
Applicants Wayne S. Roy and Melody A. Roy told the board the lot is unusual in shape and noted a prior temporary taking by a utility company reduced usable frontage; they also said the variance had been granted twice before but lapsed. Board members reviewed the prior decisions (2019 and 2021), the GIS location of a discontinued paper road adjacent to the parcel, and asked whether the lot could be handled as a retreat lot or by special permit. Counsel and members concluded retreat‑lot rules prevented a by‑right retreat lot and returned the matter to variance analysis.
A neighbor asked whether the prior four conditions would carry forward; the board confirmed the conditions would be repeated: (1) only a single‑family dwelling; (2) principal structure to be set back at least 400 feet from Elmwood Street front line; (3) driveway/access must meet current fire code standards; and (4) further subdivision of the property is prohibited. The board moved and seconded a motion to grant the variance on findings of unique circumstances and hardship due to the lot shape and utility taking; the motion carried with the required number of votes on the five‑member board.
Staff will prepare the written decision for issuance within 14 days and the standard appeal period will follow.
