Planning staff and administration said delays by utility providers (including late removal of poles and changing water district requirements) pushed the developer behind schedule. Administrator Marston said the county had used its contractual leverage previously — withholding certificates of occupancy — and noted that litigation or injunctions would be a next step if a negotiated extension were not reached. Miss Williams said passing the amendment would lift the developer from default and permit work to continue under the revised schedule; she reported the contractor had removed utility poles and was awaiting water district final tests.
The developer and KB Homes representative present told council crews are working and the project is near completion. Council members said they prefer negotiated resolution over immediate enforcement given the external constraints described by staff. The amendment passed unanimously; staff said they will monitor milestones and, if the work is not completed by the extended date, may exercise remedies set out in the original agreement.
