Commissioners noted that Nicolosi lists Gwinnett County as his residence and asked county law to review whether residency is required for board seats under the CID’s enabling statutes. County counsel reported the CID is governed by several enabling acts and that residency questions require review; historically the individual serving as manager of Perimeter Mall has held the board seat. Commissioners voted to approve the appointment "pending further information," allowing the nomination to proceed while law staff completes the residency review and confirms the appropriate appointment process.
Madam Chair said central staff would follow up with Mr. Nicolosi, and staff confirmed they would provide a written legal determination before placement on the full board’s calendar. The committee’s action preserves the customary practice of the Perimeter Mall manager holding a seat while ensuring legal compliance with residency and appointment rules.
