The Cypress City Council approved its consent calendar and, after a member pulled item 9 for discussion, approved that item as well following clarification from staff.
Council discussed the item pulled from the consent calendar — a proposed three-year communications and marketing contract — expressing concern that the term might limit flexibility for the incoming city manager. The director explained the agreement includes a clause (section 7.7) giving the city the right to terminate at any time with or without cause and with no penalty, subject only to payment for reasonable work already performed.
Councilmember Chang proposed keeping the contract term short (one year) so the next city manager could reassess whether to keep the function contracted or bring it in-house. Staff responded the contract before the council is a three-year agreement but that the termination clause makes it possible to end the contract quickly if the council chooses to do so.
Council moved and voted to approve consent items including the contract; the motion passed unanimously. The council recorded Mayor Pro Tem Medrano's abstention for item 4 earlier in the meeting.
Next steps: the contract is approved and the city retains the contractual right to terminate early; staff will proceed with contract implementation and will coordinate with the incoming city manager as appropriate.
