Hutchinson County court approves altering Old Stinnett Highway to let Phillips 66 buy right-of-way

Hutchinson County commissioners voted to alter a portion of Old Stinnett Highway to enable a sale to Phillips 66 after staff said a deed recorded in the 1930s shows the county holds title to the roadway.
County staff member Craig reported the county and Phillips 66 conducted a title search and located a deed showing the property was deeded to the county. "The county owns that property, and so we've determined that we're able to convey that as we've agreed to in the letter of intent," Craig said. He told the court that Texas Department of Transportation records show the road is no longer in TxDOT's inventory and that TxDOT does not claim an interest.
Craig recommended the court adopt a resolution that references the lengthy legal description already on record rather than reproducing it verbatim in the resolution. "Reference the legal description in volume 58, page 460, and that'll get us where we need to go," he said. He also said the next steps are to complete title insurance and proceed to closing with Phillips.
Commissioners and staff discussed the map extents and access for adjacent subdivisions. Craig said the map shows Chickasaw Street at the south end and a road just north of a tank farm at the north end; commissioners confirmed that the conveyance would not leave adjoining property owners without access. Commissioner discussion focused on ensuring alternate exits remain available for neighborhoods such as Beverly Hills.
Speaker 6 moved to approve altering the public road commonly referred to as Old Stinnett Highway in Section 68, Block 46 (Hutchinson County) to permit the conveyance described in the letter of intent; the motion was seconded and carried. Craig said he will draft the order and the resolution for signature.
The court instructed staff to include the recorded legal description (Volume 58, Page 460) in the resolution and to complete routine title work, including title insurance, before closing the transaction.
