The Planning Board voted on Oct. 21 to advance a subdivision application for 1819 Fifth Avenue toward final approval after receiving a draft easement and documents showing a fire-rated wall between the two buildings.
Lynn, the applicant—s representative, told the board the zoning board granted an area variance at its October meeting and the applicant had submitted an easement draft and documentation confirming the wall between the two buildings is fire rated. Board members questioned who would be responsible for driveway maintenance; Lynn said Building 2 (the commercial building) would maintain the driveway and, if Building 2 failed to upkeep it, the owner of Lot 1 could do so at Building 2—s expense.
During public comment, Steven Maples urged the board to reject the subdivision. "I think it's very cut and dry that this is not appropriate," Maples said, adding the proposal "does not meet the criteria for a subdivision." The board considered his remarks before taking a rollcall motion to move the application toward final approval.
A board member moved to advance the application; the motion was seconded and the members present voted in favor. The chair said he would provide signatures and the applicant was thanked. The board noted that with four members present, three votes were needed for approval.
