Innes said the court denied Hanover’s challenge, affirming the planning board’s authority to modify SLOTA permits within the statutory scope (noting the statute permits city modification of up to 10 acres) and finding no basis to overturn the board’s findings on traffic conditions. The court concluded the state Department of Environmental Protection had approved the original project, that the city’s modification was within delegated authority and that required off‑site road improvements were not shown to be absent.
