Supervisor: CalOptima investigation report to be released after waiver of privilege

Supervisor Vicente Sarmiento told the Board that the CalOptima special meeting on Oct. 16 took two actions regarding a pending investigation: it approved an investigation report prepared by Byrd Morella and waived attorney-client privilege to permit the report's public release.
"The board decided to waive the attorney-client privilege for the purpose of the public release of the report, and we directed counsel to provide notice to those that were included in the report, as witnesses and individuals who were mentioned, to go ahead and have time to challenge," Sarmiento said. He added, "the report is expected to be released to the public this Thursday."
Sarmiento said the board's earlier ethics-code updates lacked enforcement mechanisms and asked that the updated policy be taken to the ethics commission for review to consider stronger enforcement measures.
Board members thanked the public for their patience and noted staff would follow legal steps to notify named individuals before publication.
