The Planning Commission unanimously approved a major deviation Nov. 5 to reduce the rear‑yard setback at 1518 River Hill Way from 10 feet to 5 feet to permit a patio cover. Jeff Foster, Associate Planner, presented the case (LDC26-00017) and said staff found the project compatible with surrounding single‑family residences and adjacent open space. The Somerset aesthetic‑guideline committee and the Somerset Owners Association had conditionally approved the design.
Foster noted that the site is a corner lot backing a steep open‑space slope and that similar patio covers on small lots have been permitted nearby. The applicant indicated a retaining wall exists near the rear property line and that the proposed work would not affect that wall. There was no public comment and disclosures were made (Commissioner Williams disclosed service on Somerset boards but did not recuse). A motion to approve the deviation subject to the staff report's conditions carried unanimously.
The approval includes standard mitigation measures such as construction‑hours limitations to reduce neighbor impacts during work.
