Board approves Coles Way pool and patio to encroach into stream buffer with mitigation conditions

Sandy Springs planners recommended approval Nov. 5 for variance V25-23, a request to permit a 12-by-25-foot pool and a 680-square-foot paver patio to encroach into a 50-foot natural undisturbed vegetative buffer and a 75-foot impervious surface setback at 2940 Coles Way.
Helen Owens, zoning administrator, said staff's recommendation included conditions requiring a stormwater mitigation plan prepared by a registered design professional at permitting and that construction be substantially similar to the submitted site plan. Staff noted the parcel's topography and stream buffer constraints but concluded mitigation and careful siting made approval appropriate.
Tom Flowers, representing the owners, told the board the project would remove a similar square footage from the buffer as it adds and that the team would provide a tree conservation plan and buffer mitigation. "We're removing as many square feet in the buffer zone that we are adding back," Flowers said.
Board members questioned whether trees had already been removed and whether additional plantings would be required; staff said plantings had begun and further mitigation would be required through permitting.
A board member moved to approve V25-23 with staff conditions; the motion passed with one member recorded as opposed and the chair voting aye. The variance is approved subject to a signed stormwater mitigation plan and construction consistent with the approved site plans during permit review.
Permitting must demonstrate compliance with the mitigation plan and any additional arborist requirements before construction begins.
