The Town of Brownsburg on Oct. 9, 2025, tabled consideration of Ordinance 2025‑516, a proposed zoning map amendment for properties along U.S. Highway 136, after councilors and the town attorney asked the applicant to revise written commitments.
Director of Development Services Steve Fletcher said the applicant provided additional commitments as requested and could answer questions. Applicant Tim Mox said multiple iterations of the site plan corrected the right‑of‑way line and that conversations with INDOT had contemplated an additional dedication if the site is improved. "The right of way on the current site plan is accurate as are the buildings," Mox said.
Councilors and the town attorney pointed to a discrepancy between the packet language (which listed a 4‑month reservation of leasable space for sports and recreation) and the applicant’s verbal agreement of one year; the town attorney advised that a majority of the full council is required for final action and asked the record to reflect the commitment change. In response, the applicant confirmed they had agreed to one year and promised to revise the packet language.
Council Member [unnamed in record] moved to table the ordinance to the next meeting so all five members could participate and so the revised commitments could be included in the packet; the motion carried by voice vote.
The applicant also addressed drainage concerns and said detention ponds would be provided and that the site will comply with Town drainage code. The council emphasized that buffering and drainage details will be finalized through the subsequent development‑plan process or a variance application if needed.
No final rezoning vote occurred; the item will return after the applicant submits revised commitments and the council has full membership present for a final decision.
