The Lewisville Board of Adjustment voted 5–0 on the evening of the meeting to approve a variance (Case 25091ZBOA) allowing a second-story accessory dwelling unit atop an existing detached garage at 2510 Tristam Lane (the transcript includes alternate renderings of the street name). Planner Lily Sutton told the board the garage and main home were built in 1999, before the Castle Hills Planned Development district was established in 2022, and that the applicant has HOA design approval and a neighbor——s letter of support.
"Given all the supporting facts, staff recommends approval of the variance," Sutton said in her presentation. She summarized the encroachments the existing garage creates: approximately 3 feet into the required 6-foot-6-inch side-yard setback and about 5 inches into the required 5-foot rear setback.
The chair opened the public hearing and invited testimony; no members of the public spoke. Board member Rick DeWine moved to approve the variance; Joshua Chenin seconded. The chair announced the motion passed 5——to——0.
The approved variance allows the applicant, identified in the record as Ken Scaglio, to pursue an accessory dwelling unit permit for the structure despite the encroachments. Sutton noted the accessory dwelling could have been permitted "as is" if the variance were not required, given the supporting documents presented to staff.
