San Jose City Council adds amicus brief on reproductive-rights case to agenda, votes to proceed

The San Jose City Council voted unanimously on Aug. 19 to add a new agenda item — 2.17 — proposing that the city consider an amicus brief in Culture of Life Family Services v. Bonta, a case concerning reproductive rights and local enforcement authority. Mayor (presiding) described the item before Council Member Cohen moved to place it on the agenda and a colleague seconded the motion.
"This is the amicus brief in the Culture of Life Family Services v. Bonta reproductive rights and local enforcement authority," the mayor said when describing the proposed item. Council Member Cohen moved to add item 2.17 and the motion was seconded; the clerk recorded that the motion "passes unanimously." The council did not take the amicus brief up for substantive debate during the Aug. 19 session beyond adding it to the agenda.
By adding the item, the council cleared the way for formal consideration at a subsequent meeting. The motion to add item 2.17 required and received the two-thirds vote needed under the council's rules to place a new item on the day's agenda.
