The Stafford Planning and Zoning Commission on Nov. 11 voted to recommend denial of a proposed convenience store with fuel sales at 9727 Mula/Mueller Lane at Stafford Road.
Planning staff presented the application and said it requires an SUP in the RCT zoning district. Staff listed several technical conditions: replat required if both parcels are developed, fire hydrants must be shown on plans, a traffic report may be required depending on egress location, and a landscaping plan must be submitted. "Staff recommends approval, but there are a few conditions that we spoke about during the meeting that I want to go over real quick," planning staff said.
The bulk of the discussion focused on community preference and long-term land-use goals rather than a single technical deficiency. Multiple commissioners said residents have repeatedly told them they do not want more gas stations. One commissioner summarized the concern: "We have enough of these ... We don't mean more." Another commissioner asked whether that sentiment is a valid reason for denial; legal counsel read the ordinance (section 102-102.4(a)), which directs the commission to recommend approval if the use is appropriate and to state specific reasons if recommending denial.
Commissioners also raised enforceability of handicap parking and staff said they would consult the police chief on possible ticketing or fine mechanisms. Staff noted that plan reviewers had flagged possible traffic-report requirements and the fire marshal had requested hydrant locations; staff said these will be addressed in the plan-review and building-permit stages.
After extended discussion a commissioner moved to recommend denial of the SUP; another commissioner seconded and the motion passed. The commission’s vote is a recommendation; City Council retains final authority and may approve, modify, or deny the application upon formal consideration.
