Rome ZBA approves amended 8-foot privacy fence for 103 West Linden Street after split vote

The City of Rome Zoning Board of Appeals on Nov. 5 approved an amended area variance allowing an 8-foot privacy fence at 103 West Linden Street after the board moved to reduce the applicant's original 9-foot request.
Jeremy Nowakowski, speaking for the homeowner, said the existing 6-foot fence was dilapidated and the family installed an above-ground pool. He asked for a 9-foot fence to increase privacy for multiple adjacent properties. Board members questioned whether 9 feet was excessive and discussed precedent and sightlines.
Board member Raymond Tucker moved to amend the application to permit an 8-foot fence, and Jim DeCastro seconded the amendment; the board approved the amendment and then voted on the amended variance. The final tally on the amended application was 3–2 in favor. Chair John Cerbello said he would vote no because he believed a 6-foot fence would have sufficed.
The board instructed the applicant to consult with Code Office representative Mark Domenico about permitting and details; the Oneida County Department of Planning submitted correspondence (10/22/2025) noting the matter, with no recommendation to final action.
The variance applies only to the zoning setback/height requirement; any building or permit requirements remain separate and must be pursued with the Code Office.
