Creed said other contractor standby or delay charges (for example an invoice from Grayhawk shown in the packet) contributed to additional charges reported in backup materials.
Council members pressed on contractual liability, asking whether the construction manager at risk (CMAR) or the city bears costs when a line not shown in plans is struck. Staff said the plans did not show the lines and that legal review was required to determine contractual responsibility. Councilman Mormon asked for additional contractual review and clarity on 'not to exceed' protections in change orders.
After discussion, the council voted unanimously to table the change orders to the November 5 special session for legal and staff review so that council can consider a not‑to‑exceed provision and full documentation of the contractor quotes.
