City planning staff asked the commission on July 23 to recommend City Council adopt minor text amendments to the Lincoln Municipal Code’s accessory dwelling unit (ADU) chapter (18.37) to address items identified by the California Department of Housing and Community Development (HCD).
Efren Sanchez said the city adopted an ADU ordinance in July 2024 but HCD reviewed it and in April 2025 returned findings that the adopted ordinance did not fully comply with new ADU statutes that took effect Jan. 1, 2025. Staff and the city attorney prepared 11 corrections — including replacing outdated statutory references, removing provisions that conflict with state ADU rights, clarifying unit combinations, setbacks, and objective standards — and transmitted the draft amendments to HCD on June 13 and received HCD verification on June 24, 2025.
Sanchez told the commission the proposed amendments are minor, clarify state requirements, and are intended to bring the city into compliance with state law. No members of the public spoke during the public hearing. Commissioners characterized the item as largely ministerial and unanimously moved to recommend that City Council adopt the proposed amendments; the roll call vote was 7‑0.
Next steps: the planning commission’s recommendation will be forwarded to City Council for final adoption.
