The Board of Municipal and Zoning Appeals voted Oct. 21 to deny an appeal to allow after‑hours operations, a banquet hall/lounge and standalone live entertainment at a Greenmount Avenue property (case 251093226). Justin Walker of the Department of Planning told the board that in the C‑1 Neighborhood Business District the proposed uses are not permitted or properly conditioned; live entertainment may be conditional only when accessory to a restaurant, tavern or art studio, which the application did not show.
A city councilmember on the record and planning staff both cited community opposition and recommended disapproval. The chair said the board cannot grant relief that the zoning code does not authorize in the C‑1 district and moved to deny. The board rejected the application for relief on those statutory grounds; staff advised the applicant to work with the councilmember and neighborhood on alternative uses and locations that would comply with the zoning code.
