TIF 44 developer agreement approved after public call for greater transparency

The Mitchell City Council approved a developer agreement for Tax Increment Financing (TIF) District 44 on Nov. 3 after a public commenter raised concerns about transparency and overlapping TIFs.
Steve Simpson, a member of the public, told the council he could not find certified project costs for prior TIFs and warned that multiple overlapping increment districts in the Commerce Street area could total roughly $10 million in tax increment commitments. Simpson urged stronger reporting, certification of project costs and clearer accountability language in the agreement before approval.
City staff described the agreement as a standard form developer agreement that implements the TIF project plan approved at the prior council meeting. After discussion and public comment, the council approved the developer agreement by motion.
Simpson said he is working cooperatively with city and county administration to improve transparency and requested that certified project costs and a requirement for post‑construction cost certification be explicitly included in agreements going forward.
