After closed session, Delta County directs staff to focus on FAA report and stop pursuing attorney files

Delta County commissioners met in closed session on Nov. 4 to discuss a written legal memorandum under the Open Meetings Act. After reconvening in open session, the board directed administration and county legal counsel to prepare a statement relating to an FAA report and voted to stop seeking files from attorney Scott Graham.

The motion directing staff to draft a FAA-specific statement and to cease seeking files from Graham was made and approved on roll call. Administration reported that Graham “appears to not be practicing any longer” and that staff should focus work on the FAA report and on crafting a response or statement specific to that report. Commissioners also discussed that the underlying FOIA appeal process remains to be reviewed at a future meeting and that staff would present the FOIA history before any further action.

The board asked administration and prosecuting counsel to prepare the FAA-oriented draft and return with options; members also agreed to address the FOIA-file history at the next meeting. The record on the action reflects direction to prioritize finalizing an FAA-focused communication and to discontinue the county’s active pursuit of attorney Graham’s files.
