City staff told commissioners the elevation discrepancy produced about a 3.5% slope where aeronautical standards and operational safety require a more gradual grade. Because the work had been needed to maintain schedule, staff executed the repairs under the city's emergency-expenditure process and presented the change order for commission approval.
Commissioners debated liability and communications with Garver. Several members described the problem as an engineering error in Garver's original submittal; staff said the city has a claims procedure and will seek remediation from the firm while allowing the contractor to complete the work to avoid schedule delays. Commissioner House and Vice Mayor Sadler abstained from the final vote; Commissioners Baker, Johnson and Mayor Lloyd voted yes, and the motion passed.
Commissioners asked staff to compile the full cost, confirm remaining grant availability (staff noted approximately $80,000 remained in the TDOT grant for the project), and document communications with Garver so the commission can determine whether to pursue legal or contractual remedies.
