Commissioners approve Gallatin garage settlement and crosswalk MOU, recoup temporary CO fees

County mayor presented a spreadsheet showing fees on the Gallatin project; the amount Gallatin owed was described as about $907,496 and Gallatin agreed to a payment of $703,420.25. Under the proposal Gallatin would oversee construction of a pedestrian crosswalk and allocate $150,000 for that work, refunding any unused balance and providing receipts.
Commissioners pressed for written terms. Commissioner Becker asked for assurance that ‘‘they bear all risk’’ for cost overruns; the chair moved to approve the settlement contingent on an MOU that requires the City of Gallatin to bear any costs above the $150,000 allocation and to refund any underage.
Commissioner Klein and others objected to temporary certificate‑of‑occupancy (CO) fees tied to the project, describing them as a potential windfall (noting a roughly $3,018 quarterly charge leading to a recapture target of about $21,000). The commission voted to amend the motion to recapture the temporary CO fees and then voted to approve the main motion with the MOU contingency. The final approval was unanimous following the amendment.
The board directed the county attorney to draft contract language (MOU) to document Gallatin’s assumption of cost risk for the crosswalk and to require documentation of waived and refunded fees.
